Factually Kṛṣṇa is the ultimate shelter. If he has taken that shelter, he's free, immune. And that Kṛṣṇa has confirmed here. Ahaṁ tvāṁ sarva-pāpebhyo . . . (BG 18.66). If he's not Kṛṣṇa conscious, then if he gives such a duty, he's liable to fall. Therefore Kṛṣṇa says ahaṁ tvāṁ sarva-pāpebhyo mokṣayiṣ . . . "Because you are giving up all other duties, don't think that you'll be liable to punishment. I'll give you protection.".
